Terms of Use
These Terms of Use ("Terms") are an agreement between you and the Bigday developer ("we", "us") covering your use of the Bigday app for iPhone ("the app") and this website. By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.
The app is distributed through the Apple App Store and Apple's Licensed Application End User License Agreement also applies. Where these Terms and Apple's agreement conflict, Apple's agreement prevails to the extent of the conflict.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple-branded devices that you own or control, as permitted by the App Store usage rules. You may not copy, modify, reverse engineer, or redistribute the app except where the law expressly allows it.
2. The free version
The free version of the app lets you create up to two events, use every widget size in the Classic and Minimal styles, and use four themes. We may adjust what the free version includes in future releases, but we will not remove the ability to display a working widget from the free version.
3. Bigday Pro
Bigday Pro unlocks unlimited events, all themes, photo backgrounds, all widget styles, and watermark-free share cards. Pro is available in two ways:
- Lifetime. A one-time in-app purchase (non-consumable). Once bought, Pro is yours on every device signed in to the same Apple ID, and it can be shared with your family through Family Sharing.
- Yearly. An auto-renewing subscription described in section 4.
Prices are shown in the app in your local currency before you confirm a purchase and may vary by country. All purchases are made through and processed by Apple.
4. Yearly subscription and free trial
- The yearly plan begins with a 3-day free trial for eligible new subscribers. When the trial ends your Apple ID is charged the yearly price unless you cancel at least 24 hours before the trial ends.
- The subscription renews automatically each year at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- You can manage or cancel the subscription in iOS Settings › your name › Subscriptions, or in the App Store app. Deleting the app does not cancel a subscription.
- Any unused portion of a free trial is forfeited when you purchase the lifetime plan.
- If the price increases, Apple will notify you and, where required, ask for your consent before the new price applies.
5. Refunds and restores
Because Apple processes all purchases, refund requests are handled by Apple under its policies. You can request one at reportaproblem.apple.com. To restore a purchase on a new device, open the app, go to Settings or the Pro screen, and tap Restore. You must be signed in with the Apple ID that made the original purchase.
6. Your content
You own the event details and photos you add to the app. They are stored on your device and, if you enable iCloud, in your own iCloud account. We do not have access to them and claim no rights over them. You are responsible for making sure you have the right to use any photo you add, and for any share card image you choose to export and distribute.
7. Countdown accuracy
The app calculates day counts from the date you enter and the date, time zone, and calendar settings of your device, in whole calendar days. Widgets are refreshed by iOS on a schedule the app requests; in rare cases iOS may delay a refresh, for example in Low Power Mode or after a restart. Bigday is a companion for remembering dates, not a system of record. Do not rely on it for legal, medical, financial, or safety-critical deadlines.
8. Acceptable use
You agree not to use the app or website to break any law, to infringe anyone's rights, to interfere with the App Store or Apple's services, or to attempt to gain access to features you have not purchased other than through the app's own purchase and restore flows.
9. Intellectual property
The app, its design, themes, widget styles, icon, and the content of this website are owned by the developer and protected by copyright and other laws. "Bigday" and the Bigday icon are our marks. Apple, iPhone, App Store, and iCloud are trademarks of Apple Inc. Nothing in these Terms transfers any of these rights to you.
10. Disclaimer of warranties
The app and website are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, uninterrupted, or that widget refreshes will occur at any particular moment. Some jurisdictions do not allow these exclusions, so some may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed dates, or lost profits, arising out of or related to the app or these Terms. Our total liability for any claim will not exceed the amount you paid us for the app in the twelve months before the claim, or ten US dollars, whichever is greater. Nothing in these Terms limits liability that cannot be limited by law.
12. Termination
You may stop using the app at any time by deleting it. We may suspend or end your licence if you materially breach these Terms. Sections 6 and 9 to 14 survive termination.
13. Changes
We may update these Terms from time to time. The effective date at the top of this page will change, and material changes will be noted in the App Store release notes. Continuing to use the app after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the developer's country of residence, without regard to conflict-of-law rules, and any dispute will be brought in the courts of that country, except where the consumer-protection law of the country you live in gives you the right to bring proceedings there. Apple is a third-party beneficiary of these Terms and may enforce them against you.
